OLYMPIA – The state Court of Appeals has upheld the conviction of an inmate at the Clallam Bay prison who assaulted corrections officers five years ago.

46-year-old Terrence Lavery was convicted in January last year in Clallam County Superior Court in the case.

The case stems from an incident in August 2013 when Clallam Bay Corrections Officers Stephen Monger and Jacob Martin were attempting to serve lunch to Lavery. The officers felt a liquid substance hit their clothes and arms as they continued to the next cell. The officers believed the liquid was human waste and came from Lavery’s cell’s mail slot.

Lavery was sentenced to four years in prison and another year of community custody. He appealed his convictions.

Yesterday, the Court of Appeals upheld the convictions but ordered the case back to Clallam County to reduce the period of community custody so that the total prison sentence and community custody does not exceed the maximum 60 months.
