PORT ANGELES – No charges will be filed against a Port Angeles woman whose eight-year-old son ingested LSD he’d found in the home’s freezer last month.

Clallam County Prosecutor Mark Nichols said in a memorandum obtained by KONP that he’s reviewed the charge of Reckless Endangerment that was referred by the Sheriff’s Office as well as other potentially relevant charges available and concluded that he was unlikely to get a conviction from a jury under the “beyond a reasonable doubt standard.”

Nichols says he looked at possible Assault charges and determined he would have show intent to deliver the substance on the part of the mother, which he can’t do.

The memorandum says the mother had hidden 4 doses of LSD in a broken ice maker in a freezer the child could not ordinarily reach because of his height.

As for the recommended charge of Reckless Endangerment, Nichols said he’d have to show the woman created a substantial risk of serious injury or death by knowingly disregarding conduct that a reasonable person would exercise in the same situation.

Nichols compared the situation to cases where children accidently get into a medicine cabinet or cleaning liquids, and points out that while the decision to have LSD in the home is concerning, at the time this occurred, possession of such drugs has been effectively decriminalized statewide.

He concludes by writing, “…I do not believe I can prove (the woman) acted recklessly beyond a reasonable doubt. It would be unethical for me to file such charges, despite the grave concerns presented here.”
